The Transplant of Human Organs Act (THOA) has been operational since 1994. Rules under THOA and THOA itself have been amended to further reduce illegal transplantation and organ trafficking and increase organ availability.

India is committed to follow WHO Guiding Principles for organ transplantation.

To increase organ availability and promote organ donation from deceased persons, a pilot project in the Delhi region has been planned with the view to development for the whole of India during the five year plan period 2012-17.
